What are the grounds and residency requirements to file for an uncontested or "no-fault" divorce in Georgia?

  1. At least one of the parties is currently a resident of Georgia, and has maintained the residency for at least the last six (6) months. The requirement is twelve (12) months for active duty military personnel residing at a military installation in Georgia.
  2. The parties agree on all details, or at least make no objections.
  3. A Marital Settlement Agreement (MSA) signed by both parties and filed in court may be used in any divorce. A MSA is highly recommended if minor children are involved, or if alimony or child support will be requested.
  4. If the parties do not have minor children, the court can grant a divorce (finalize the process) 30 days or later after the divorce documents have been filed with the court. If the parties have minor children, the court cannot grant a divorce (finalize the process) until at least 120 days after the divorce documents have been filed with the court (this requirement may be waived by the court if the parties have a signed MSA).
